Terms of Use

1. Introduction

These Terms of Use (the “Terms of Use”) apply to the PANORAMIC RV website panoramicrv.com, and also any other PANORAMIC RV website, any mobile sites, online portals, social media pages, applications, widgets, and other interactive features that link said websites (the “Site”). Use of the Site is governed by the Terms of Use, which constitutes an agreement between you and PANORAMIC RV.

The Site is the property of Groupe VRP Inc. and is used for the purpose of promoting its own business in Canada. It is also used, under license, exclusively for informational purposes about Panoramic RV Corporation’s business and products in the United States (hereinafter, collectively referred to as “PANORAMIC RV”, “VR PANORAMIC”, “us,” or “we”, unless specifically referred otherwise).

2. Acceptance of the Terms of Use

BY USING THIS SITE, YOU AGREE AND ACCEPT TO: (1) these Terms of Use, and (2) the Privacy Policy. You also affirm that you are at least eighteen (18) years old or have parental permission to use the Site. You further agree that you will not use the Site for any unlawful or fraudulent purpose or in any manner inconsistent with these Terms of Use. You further warrant that you will not violate or attempt to violate the security of the Site.

If you do not agree to any of these Terms of Use, or the Privacy Policy, please do not use the Site.

These Terms of Use may be changed in the future without further notice. Further, these Terms of Use apply exclusively to your access to, and use of, this Site and do not alter in any way the terms or conditions of any other agreement you may have, now or in the future, with PANORAMIC RV.

You agree to comply with the Terms of Use, all applicable laws, rules and regulations in accessing and/or using the Site. In addition, your use is conditioned on your compliance with the following rules of conduct and all other provisions contained in the Terms of Use.

You agree not to:

  • Use the Site for any fraudulent or unlawful purpose;
  • Impersonate any person or entity, including any PANORAMIC RV employee, agent, or representative;
  • Falsely state or otherwise misrepresent your identity or your affiliation with any person or entity;
  • Express or imply that we endorse any statement you make;
  • Interfere with or disrupt the operation of the Site;
  • Restrict or inhibit any other person from using the Site;
  • Transmit or otherwise make available any virus, worm, Trojan Horse, or other harmful code;
  • Interfere with or violate any other website visitor’s or user’s rights to privacy or other rights;
  • Harvest or collect personally identifiable information without prior express consent;
  • Frame or mirror all or any part of the Site without our prior express written consent.

5. Informational purposes only & pricing

The Site and the products shown on the Site are not an offer to buy or sell recreational vehicles. All illustrations, images, videos, blog posts, details and specifications presented through the Site are for informational purposes only.

Some vehicles may be shown with features or equipment that are unavailable in Canada and/or the United States. PANORAMIC RV reserves the right to discontinue without notice or change specifications on products and equipment appearing on the Site.

The pricing information, if any, typically reflects MSRP and may change without notice and may vary from country to country, region to region and dealer to dealer. Moreover, pricing information, if any, does not reflect any options unless expressly indicated.

6. Account registration

Certain features of the Site may require you to register an account. You are responsible for maintaining the confidentiality of your account and password. You may be required to provide certain personal information; in that case, please read our Privacy Policy.

You accept responsibility for all activities that occur under your account or password. PANORAMIC RV reserves the right to terminate your account without cause and without notice.

7. Licensing

By submitting any content to or through the Site, you automatically grant us an irrevocable, perpetual, free, worldwide, non-exclusive license to use, copy, display, transmit, publicly perform or delete the content. You also represent and warrant that you own all rights in and to the content.

To that extent, PANORAMIC RV is not responsible, or liable to any third party, for the content or accuracy of any user content you provided, or that another user of the Site provided.

8. Commercial and similar uses not permitted

No commercial use of the information on or under this Site is licensed or permitted. For example, the use of automated systems such as robots, spiders, or other information scrapers to access, acquire or download information on this Site is expressly prohibited where such systems are employed in connection with commercial objectives, affect the operation of this Site in any manner, or directly or indirectly violate the privacy interests of any person.

You acknowledge and agree that this Site and its content are and shall remain the property of PANORAMIC RV and/or its licensors, and are protected by copyright, trademark, and/or other proprietary rights and laws.

Except as expressly authorized in advance by PANORAMIC RV, you agree not to copy, distribute, transmit, display, perform or create derivative works of the materials. PANORAMIC RV grants you a limited, personal, revocable and non-transferable license to access the materials via the internet solely for viewing purposes and to print pages of this Site for your personal, non-commercial use.

Any other use of the materials, including any commercial use, reproduction, modification, distribution, republication, display, or performance, without the prior express written consent of PANORAMIC RV is prohibited.

This Site may include discussion forums or other interactive areas, including chat rooms, bulletin boards or collaboration facilities.

You agree not to upload, distribute or otherwise publish through this Site any content that is unlawful, libelous, defamatory, obscene, pornographic, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable, or that would constitute or encourage a criminal offense, violate the rights of any party, create liability or violate any law.

Forums and interactive areas shall be used only for non-commercial purposes. PANORAMIC RV reserves the right, in its sole discretion, to remove or edit any material posted by you that is determined to be harmful, offensive or otherwise inappropriate.

11. Copyright infringement by your postings

By posting content of any nature, including software, to or through this Site, you warrant that such content is free shareware, otherwise in the public domain, or owned by you, and you agree to indemnify us against all claims, damages, or losses arising from an action alleging infringement of copyright or other proprietary rights in such works.

The Site may contain hyperlinks to other websites or resources offered by third parties. Such websites are not controlled by us and are for your convenience only. Reference to any services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by PANORAMIC RV.

13. Dealers

PANORAMIC RV may grant independent contractors selling rights to its products, hereinafter referred to as “Dealers / Independent Sales Representatives”. Dealers / Independent Sales Representatives are independent third parties and are not otherwise affiliated with us.

PANORAMIC RV is not responsible or liable for the statements, acts or omissions of the Dealers / Independent Sales Representatives whether through or in connection with the Site, or otherwise.

We may at any time, at our sole discretion, revise or otherwise update these Terms of Use by posting changes here, which will be effective immediately.

PANORAMIC RV DOES NOT REPRESENT OR WARRANT THAT MATERIALS IN THIS SITE ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. PANORAMIC RV DOES NOT REPRESENT OR WARRANT THAT THIS SITE OR ITS SERVER(S) ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Limitation of liability

17. Applicable laws

For Canada, originating or using from panoramicrv.com, any mobile sites, online portals, social media pages, applications, widgets, and other interactive features that link webpage: the laws of the Province of Québec, Canada shall govern the construction and interpretation of these Terms of Use and the rights of the parties hereunder.

Any controversy or claim arising out of or relating to your use of this website or any services provided hereunder shall be settled by binding arbitration to be held in the English or French language in Montreal, Québec, in accordance with the commercial arbitration rules of the Code of Civil Procedure, Book VII, Title I.

For U.S., originating or using from panoramicrv.com, any mobile sites, online portals, social media pages, applications, widgets, and other interactive features that link webpage: the laws of the State of California shall govern the Terms of Use.

Any dispute arising from these Terms of Use shall be resolved exclusively in the state of California, without regard to any conflict of law provisions. You agree that any and all legal claims concerning your use of the Site must be commenced within one (1) year after the claim or cause of action arises.

18. Communication

Communications between you and us are made through electronic means via the Site, including social media, e-mail, or text messages. You consent to receive communications from us in an electronic form.

This Site is maintained and operated by PANORAMIC RV at least in part on a server located in Canada. While PANORAMIC RV has tried to provide accurate and timely information, there may be inadvertent technical or factual inaccuracies and typographical errors, for which we apologize.

20. Warranty

The Site is not for submitting any warranty claims or request for repair. Refer to the Owner’s Manual for full details on warranty procedures.

21. Termination

Notwithstanding any of these Terms of Use, PANORAMIC RV reserves the right, without notice and in its sole discretion, to terminate your license to use this Site, and to block or prevent future access to and use of this Site.

22. Severability

If any provision of these Terms of Use shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
